Affiliate Program Terms & Conditions

These Terms & Conditions govern participation in the Well & Earth Affiliate Program (“Program”), operated by HEALTHDOT LTD, Cyprus, trading through Well & Earth Concept Store (“Well & Earth”, “we”, “us”, “our”).
By applying to or participating in the Program, you (“Affiliate”) agree to these Terms & Conditions.
1. Affiliate Program
The Program allows approved Affiliates to promote products available through Well & Earth and earn commission on qualifying purchases generated through their unique affiliate referral link or personal discount code.
Participation in the Program is subject to approval by Well & Earth. We reserve the right to accept or reject any application at our discretion.
2. Affiliate Discount Code
Approved Affiliates will receive a unique promotional code providing customers with 10% discount on eligible purchases from Well & Earth.
The code may be promoted through the Affiliate's approved social media accounts, website, blog or other agreed promotional channels.
Affiliate codes may not be published on coupon/deal websites, cashback websites, browser extensions, discount-code directories, deal forums or similar platforms whose primary purpose is distributing promotional codes.
Affiliates may not sell, transfer or otherwise provide their affiliate account or code to another person for commercial use.
Discount codes are subject to the discount conditions applicable at checkout and may not be combined with other promotions or discount codes unless expressly permitted by Well & Earth.
3. Affiliate Commission
The standard affiliate commission is:
3% on qualifying sales of Well & Earth products, except for the following brands:
5% on qualifying sales of Pureborn, Kit & Kin and Freemore products.
Commission rates are calculated automatically according to the products contained in each qualifying order.
Commission is calculated on the eligible product value after discounts and excluding VAT, taxes and shipping charges.
Well & Earth reserves the right to modify commission rates in the future. Affiliates will be informed of material changes applicable to the Program.
4. Qualifying Sales & 30-Day Attribution
A sale qualifies for commission when it is successfully attributed to the Affiliate through their referral link or affiliate code and meets the requirements of the Program.
Referral-link tracking uses a 30-day attribution period. If a customer follows an Affiliate's referral link and completes an eligible purchase within the applicable tracking period, the sale may be attributed to that Affiliate, subject to the tracking and attribution rules of the Program.
Use of an Affiliate's valid personal discount code may also be used to attribute an eligible order to that Affiliate.
Where tracking information is unavailable, blocked, deleted or otherwise cannot reliably identify the Affiliate, Well & Earth cannot guarantee attribution of the sale.
5. Personal Purchases & Self-Referrals
Affiliates may not earn commission on their own purchases.
Affiliates must not use their own referral link or affiliate code to generate commission from purchases made by themselves or purchases placed on their behalf.
Attempts to create artificial referrals, duplicate accounts, fraudulent orders or otherwise manipulate the Program may result in cancellation of commissions and termination from the Program.
6. Returns, Refunds & Cancelled Orders
Commission is earned only on valid, completed sales.
No commission is payable on orders that are cancelled, refunded, returned, fraudulent, unpaid or otherwise reversed.
If commission has already been recorded for such an order, Well & Earth may cancel or deduct that commission from the Affiliate's current or future balance.
7. Affiliate Payments
Affiliate commissions are reviewed and paid monthly.
Commission becomes eligible for payout after a 30-day validation period following the relevant sale, allowing sufficient time for cancellations, refunds and returns to be processed.
The minimum payout threshold is €50.
If an Affiliate's approved commission balance is below €50, the balance will automatically carry forward until the minimum payout threshold is reached.
Payment will be made using the payment method made available or agreed through the Affiliate Program.
Affiliates are responsible for providing accurate payment information and for any tax, reporting, invoicing or other legal obligations applicable to income they receive through the Program.
8. Social Media & Promotional Content
Affiliates are encouraged to promote Well & Earth and its products through genuine content on platforms such as Instagram, TikTok, Facebook, YouTube, blogs and other appropriate channels.
Affiliates must clearly disclose their commercial relationship with Well & Earth whenever required by applicable advertising, consumer-protection or platform rules. Appropriate disclosures may include terms such as #ad, #affiliate, “affiliate link”, or an equivalent clear disclosure appropriate to the platform and circumstances.
Affiliates must not make false, misleading or unsubstantiated claims about Well & Earth or any products sold by Well & Earth.
Where Well & Earth provides official product images, videos, logos or other marketing materials, Affiliates may use those materials solely for the purpose of promoting Well & Earth under this Program.
9. Paid Advertising & Brand Protection
Affiliates may not run paid search advertising using the Well & Earth name, HEALTHDOT LTD name, our brand names, trademarks or confusingly similar variations without prior written approval.
Affiliates may not impersonate Well & Earth, create accounts or websites that could reasonably be mistaken for official Well & Earth channels, or misrepresent their relationship with Well & Earth.
Affiliates are independent participants in the Program and are not employees, agents or representatives of HEALTHDOT LTD.
10. Prohibited Activity
Well & Earth may reject sales, cancel commissions or terminate an Affiliate account in cases involving fraud, misleading advertising, spam, misuse of discount codes, unauthorized paid advertising, coupon-site distribution, artificial referrals, self-referrals, intellectual-property infringement or any activity that may damage Well & Earth's reputation or violate applicable law.
11. Changes to the Program
Well & Earth may modify the Program, including commission rates, discount levels, eligible products, payout conditions and these Terms & Conditions.
Where a material change affects existing Affiliates, reasonable notice will be provided where practicable.
Continued participation in the Program following the effective date of updated Terms constitutes acceptance of those Terms.
12. Termination
Either the Affiliate or Well & Earth may end participation in the Program at any time.
Upon termination, the Affiliate must stop representing themselves as a Well & Earth Affiliate and discontinue use of any promotional materials where continued use would imply an ongoing affiliation.
Valid commissions earned before termination may remain payable subject to the validation period, minimum payout threshold and these Terms. Well & Earth may withhold or cancel commissions associated with fraud, prohibited activity, cancelled orders, refunds or violations of these Terms.
13. Intellectual Property
All Well & Earth trademarks, logos, product imagery and other intellectual property remain the property of their respective owners.
Participation in the Program grants the Affiliate a limited, non-exclusive and revocable right to use approved promotional materials solely for the purpose of promoting Well & Earth through the Affiliate Program.
No ownership rights are transferred to the Affiliate.
14. Limitation of Liability
To the extent permitted by applicable law, Well & Earth and HEALTHDOT LTD will not be liable for indirect or consequential losses arising from participation in the Program, including losses resulting from tracking interruptions, technical failures or changes to the Program.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
15. Governing Law
These Terms & Conditions and participation in the Well & Earth Affiliate Program are governed by the laws of the Republic of Cyprus.
Any dispute arising in connection with the Program will be subject to the jurisdiction of the competent courts of the Republic of Cyprus.
